The Heritage Foundation and Federalist Society are also readying resources to ensure a nominee is confirmed.

Conservative on firearms and election financing, Kennedy could be more progressive on issues such as abortion and affirmative action. However, Democrats are expected to fight against the confirmation since Kennedy's departure serves as the loss of a deciding swing vote on many progressive issues.

The president's attention in the coming days will be on meetings in Europe. But the process of vetting the nominee will start right away.

Minority Leader Chuck Schumer laid out a plan to impede the appointment, which he hopes will "lead to a more independent, moderate selection that both parties can support". "And I expect we will do that on sort of a normal timetable, a couple of months".

"Just as they held the Merrick Garland seat open on the Supreme Court, they also held open an terrible lot of vacancies on the district courts and the courts of appeal", said Russell Wheeler, who tracks judicial nominations at the Brookings Institution.
