Less Than Half of The Separated Immigrant Toddlers Will be Reunited By Tomorrow's Deadline

The vast majority of kids remain separated.

PolitiFact chose to take a closer look at the issue to lay out what's known and what remains uncertain about the process.

The U.S. government is working to reunite around 2,000 children with their parents, who were detained and separated as part of Trump's "zero tolerance" approach to deter illegal immigration.

Lead attorney Lee Gelernt wrote that ACLU has been unable to verify the government's claim that it reunited the 57 children, and said the government did not alert the ACLU about the release of each person from detention, as they had agreed to in court.

The 46 children will remain in the care of Health and Human Services, which will continue to seek to place them with a sponsor, such as other family members or even foster care, as it does for the more than 10,000 other minors who arrived in the USA without a relative.

The Trump administration said early Thursday that officials have reunited 57 of 103 young migrant children with their parents after separations of weeks or months, but would not return another 46 children for reasons that range from concerns about their safety to their parents having been deported. The parent of one child has simply disappeared. Justice Department attorneys have been under a 6 p.m. ET Thursday deadline to explain to Dana Sabraw, the USA district judge behind the court order, how they returned the eligible children - and why the rest are ineligible for return under the court's guidelines. It also asked for the government to complete its verification process for the parents by July 19.

Shortly after the hearing, the government filed the broad outlines of its reunification plan with the court, saying it meant to identify six to eight sites to process the larger group of 2,551 older children on a rolling basis starting Friday.

But the principal point of contention is likely to be the matter of eligibility: How did federal officials decide that more than three dozen children can not be safely returned to their parents at this time - and was that decision in line with the court's criteria? The remaining children's parents had been deported or were in custody for other reasons.

"You know there are people who will do or say anything to get into the United States". The human services department on July 10 said records showed the parent and child "might be USA citizens".

The federal government has until 26 July to return the remaining children.

The ACLU also said the government failed to communicate with the plaintiffs about when and where immigrants would be released, something it had promised the judge it would do.

"Our work to reunite the second group of families ... continues", added Albence, saying the process will be completed "as safely and as efficiently as we did with the first group".

This followed their arrests for crossing the U.S. -Mexico border, after a more than monthlong journey from El Salvador. "This is the only way to be sure that we're putting the child in an appropriate place, reuniting them with the right person".

Justice Department lawyer Sarah Fabian told the judge that it was a "huge ask" for the government to pay travel costs and that such payments were not in the government's budget.

Meanwhile, some reunions of older children are happening around the country. Reviews of cases involving children 5 to 17 years old are being done on a case-by-case basis.

The administration was under a court mandate to reunite families separated between early May and June 20, when President Donald Trump signed an executive order that stopped separations. The government initially identified 102 children who fell in that category, but the number has fluctuated in recent days, as Sabraw's order has essentially functioned as a judicially mandated audit of the morass of systems used by different federal agencies.

The government maintained in the filing that it is complying with the judge's orders. Another federal judge is considering a government motion to let parents choose between staying with their children in long-term ICE detention or voluntarily giving their children to HHS while they await legal proceedings, the New York Times reported.

The nonprofit insurer sued the government in 2016 claiming the risk adjustment program unfairly penalized smaller insurers. The agency also said that the people confused by health insurance benefits can use insurance agents and brokers for help.


Sessions announced the zero-tolerance policy in May, although some separations happened before then.
