In a court hearing earlier this week, he said he had been unfairly detained on "meritless and unsubstantiated accusations".

Japan's prosecutors have faced criticism for a lack of clarity and communication on how they are handling the case, with Ghosn held in detention without charge for longer than would be permitted in the United Kingdom for a suspected terrorist. Ghosn has been detained since his arrest a year ago.

Ghosn lost an appeal against his ongoing detention, diminishing the prospects of an early release on bail.

Motonari Otsuru confirmed that Ghosn had been indicted on the fresh allegations and said he would "shortly request his release on bail".

On Wednesday, the Tokyo District Court rejected a request filed by Ghosn's defense counsel to end his detention following his arrest on allegations of financial misconduct.

The auto executive's Japanese lawyers applied for bail soon after the new indictment on Friday. Prosecutors may come up with new allegations or charge him.

Sources close to the matter said Friday, however, that his legal team would likely seek bail for their client, despite a Tokyo judge believing Ghosn may destroy evidence and flee the country, if bail is granted.

Ghosn's lawyers are now able to meet him.

Ghosn's wife, Carole, painted a glum picture of her husband's state, saying she's fearful for his health and that he's been denied access to his family since the November 19 arrest in Tokyo.

Ghosn and Kelly were arrested by the special investigation unit on November 19 on suspicion of failing to report some 5 billion yen of the former chairman's remuneration in financial statements for fiscal 2010 to 2014, and indicted on December 10 over the matter.

The second charge filed Friday is for aggravated breach of trust, which involves a complex scheme under which Ghosn allegedly tried to transfer losses on foreign exchange contracts to Nissan's books.

An individual convicted of aggravated breach of trust faces a fine of up to 10 million yen and/or a maximum prison term of 10 years.

His lawyers argue that Ghosn had acted with the approval of Nissan's board and officers. "We are fearful and very anxious his recovery will be complicated while he continues to endure such harsh conditions and unfair treatment".

Nissan said Friday it has filed its own criminal complaint against its former chief "on the basis of Ghosn's misuse of a significant amount of the company's funds".

"The review process has examined the compensation of the current Groupe Renault Executive Committee members for the financial years 2017 and 2018 and has concluded that it is both in compliance with applicable laws and free from any fraud", it said in a statement.

Renault, which is the biggest shareholder in Nissan, has refrained from removing Ghosn, instead appointing interim replacements.

Japanese media, citing Ghosn's lawyers, said Thursday that he was suffering from a high fever and unable to meet investigators for questioning.
