N.Y. Appeals Court Rules Trump Can’t Avoid Summer Zervos’ Defamation Suit

Summer Zervos' lawsuit against President Donald Trump can proceed, court rules

A NY appellate court ruled Thursday that President Trump must face a defamation lawsuit filed by former "Apprentice" contestant Summer Zervos, one of about a dozen women who accused Trump of sexual misconduct shortly before the 2016 election.

The Appellate Division's First Judicial Department of the New York Supreme Court ruled against Trump in a 3-2 decision Thursday.

Mr. Trump's lawyers have long sought to halt the case brought by Summer Zervos, a California restaurateur who appeared in 2006 on Mr. Trump's NBC reality show "The Apprentice".

He called the women "liars" trying to harm his campaign with "100 percent fabricated" stories, and he retweeted a message specifically calling Zervos' claim "a hoax".

He sustained a head injury, which was not believed to be serious, and was kept in hospital for treatment, the police added. Christchurch is a city of about 400,000 residents, still recovering from a massive quake in 2011 that killed 187 people.

A U.S. Supreme Court decision in the similar federal case Clinton v. Jones acknowledged that a hypothetical state court case would involve separate issues, and thus the Jones case didn't control such a situation.

The decision, which increases the prospect that Trump could have to sit for sworn questioning in the lawsuit, was not unanimous. Her resolve to stay quiet changed, she said, after an "Access Hollywood" recording emerged in October 2016 of Trump boasting about groping women.

Trump's attorneys had argued that the suit could not move forward because it would violate the Supremacy Clause-which elevates the Constitution and federal laws over state laws-by interfering with Trump's ability to do his job.

Justice Jennifer Schecter originally allowed the case to proceed in March of past year, arguing that nothing in the U.S. Constitution's Supremacy Clause suggests the president is immune from civil lawsuits.

"The case has proceeded in the trial court and discovery continues", Mariann Wang, Zervos's attorney, said in a statement. In a June 2018 lawsuit, the Attorney General claimed the foundation was operated as a "shell corporation that functioned as a checkbook" for Mr. Trump, his campaign and businesses.

The lawsuit - first filed under her predecessor, Barbara Underwood - asks for Trump to pay millions in penalties and restitution, and to be barred from serving on the board of any NY charity for 10 years.

Trump is represented in the case by his longtime personal lawyers at Kasowitz Benson Torres LLP. "The result the Supreme Court reached in Jones. may well have been entirely correct".
